This website is operated by Flashing Kings LLC through Shopify. Throughout the site, the terms “we”, “us” and “our” refer to Flashing Kings LLC. Flashing Kings LLC offers this website hosted by Shopify, including all information, tools and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here.
By visiting our site and/ or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including those additional terms and conditions and policies referenced herein. These Terms of Service apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/or contributors of content.
Please read these Terms of Service carefully before accessing or using our website. By accessing or using any part of the site, you agree to be bound by these Terms of Service. If you do not agree to all the terms and conditions of this agreement, then you may not access the website or use any services. If these Terms of Service are considered an offer, acceptance is expressly limited to these Terms of Service.
Any new features or tools which are added to the current store shall also be subject to the Terms of Service. You can review the most current version of the Terms of Service at any time on this page. We reserve the right to update, change or replace any part of these Terms of Service by posting updates and/or changes to our website. Our store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products and services to you.
ONLINE STORE TERMS
By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority in your state or province of residence and you have given us your consent to allow any of your minor dependents to use this site.
You may not use our products for any illegal or unauthorized purpose nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws).
You must not transmit any worms or viruses or any code of a destructive nature.
A breach or violation of any of the Terms will result in an immediate termination of your Services.
GENERAL CONDITIONS
We reserve the right to refuse service to anyone for any reason at any time.
You understand that your content (not including credit card information), may be transferred unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices. Credit card information is always encrypted during transfer over networks.
You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service, or access to the Service or any contact on the website through which the service is provided, without express written permission by us.
The headings used in this agreement are included for convenience only and will not limit or otherwise affect these Terms.
SALES POLICY
1. Prices
Prices listed do not include shipping, handling fees, taxes, or duties. All pricing subject to correction or change. Additional shipping and handling fees may be assessed for custom or large orders. Market sensitive commodity products are priced according to market conditions and may change.
2. Sales Tax
Flashing Kings LLC will charge sales tax on all shipments when applicable.
3. Payment
Flashing Kings LLC accepts cash, Visa, Mastercard, Discover, American Express, and PayPal. All payments are to be made in US dollars. No credit will be issued by Flashing Kings, all orders to be paid in full before shipping.
4. Flashing Kings RESERVES THE RIGHT TO ACCEPT OR REJECT ANY ORDER

SHIPPING POLICY
*Experiencing high order volumes. Please expect extended lead times of approximately 15 days before a shipping notification is received. Orders will not ship for ~15 days until we catch up. Sorry for the inconvenience.
1. All orders will be fulfilled as quickly as possible. In-stock items usually ship by next business day. We make every attempt to ship all other orders within three business days. Out of stock items can be fabricated with minimal lead times, or may be out of stock because free shipping does not apply. For complex custom orders or large orders, processing times may vary. We make every effort to maintain accurate inventory counts. If a product is out of stock this may affect processing and shipping times. We currently ship through USPS, UPS, FEDEX, or DHL for standard size orders. Their policies apply to all orders. Shipping times may vary depending on service chosen by the customer. Ownership and risk of loss pass to the customer upon delivery of a shipment to a carrier. We use a variety of carriers for LTL shipments and rates may vary. We will not be held liable for any freight damage if the delivery receipt is not signed as damaged, concealed damaged, or failure to sign as concealed short. Customer may also be responsible for any accessorial charges applied by carrier not included in the original shipment (such as lift gate deliveries, residential deliveries, notifications/appointments, an inside deliveries). We reserve the right to update shipping costs due to unforeseen circumstances. Not all products or orders will qualify for the standard shipping policy. Free Shipping applies to domestic orders within the lower 48 only. You will be contacted with a shipping quote if your order does not qualify (this may be due to location, product size, weight, quantity, hazardous material, or any other unforeseen circumstance). Any charges incurred for hazardous materials or other special handling by the carrier must be paid by the customer. Fuel Surcharges may also be applied. Orders to international destinations will not be processed. Flashing Kings LLC will not ship to a P.O. Box.
2. We can offer expedited shipping for in-stock inventory. To qualify for expedited shipping Flashing Kings LLC must receive your order before 11AM MST Monday through Friday for same day processing. All expedited orders must weigh less than 100lbs and not contain any hazardous materials. Expedited orders will only ship on business days; any orders placed on weekends/holidays will be processed next business day. Contact us for options.
3. For dropship products, shipping times may vary. Items are subject to suppliers' and carrier's terms.
RETURN POLICY
If you are not satisfied for any reason products may be returned within 30 days of shipment for refund or exchange (provided product is undamaged). Items must not have been installed or altered in any way. Items must be returned in original packaging. Return shipping is the responsibility of the customer. Refunds will not be issued until items are in house and have been inspected. Orders canceled before shipping or the start of fabrication for custom items will be subject to a processing fee of 3%.
Note: Custom made products do not qualify. We can not accept returns for any custom fabricated or altered products.

PRODUCT COMPLIANCE AND USE
States/Counties have varying laws, codes, and regulations related to construction, installation, and/or use of products. Flashing Kings LLC does not guarantee compliance or suitability of the products manufactured and/or sold with any laws, codes, regulations, nor does Flashing Kings LLC accept responsibility for construction, installation, or use of a product in any manner. Certain products may not be available for sale in all areas. It is the customer’s responsibility to review product applications and all applicable laws/regulations.
PRODUCT INFORMATION
1. Website information
Product depictions on the website are for illustrative purposes only. Flashing Kings LLC reserves the right to revise errors on the website. Despite our efforts, occasional errors may occur. Flashing Kings LLC reserves the right to cancel orders resulting from any error, including pricing errors, even if the customer has received a confirmation from Flashing Kings LLC. Products are hand made, expect slight variation and/or imperfections. All items inspected before shipping for quality. Please see return policy for more information.
2. Occupational Safety and Health Administration (OSHA) Hazardous Substance
Material Safety Data Sheets(MSDS) for OSHA defined hazardous substances are prepared and supplied by manufacturers. Flashing Kings LLC makes no warranties and expressly disclaims all liability to any customer or user with respect to the accuracy of the information or suitability of the recommendations in any MSDS. Customer is solely responsible for any reliance on or use of any information, and for use or application of any product.

The State of California requires that certain warnings be given concerning products subject to Proposition 65. For products denoted with a symbol the following warnings apply:

4. CALIFORNIA, LOUISIANA, MARYLAND, AND VERMONT CUSTOMERS
Regulations in CA, LA, MD and VT prohibit the introduction into commerce of any solder, flux, pipe, pipe or plumbing fitting, or fixture intended to convey or dispense water for human consumption that is not “lead free”. The maximum allowable lead content is 0.25 percent lead in wetted surfaces of pipes, pipe fittings, and plumbing fittings and fixtures, as determined by a weighted average. The maximum allowable lead content is 0.2 percent lead in solder and flux.
GENERAL TERMS
INTELLECTUAL PROPERTY
Customers shall have no right, title or interest in copyrights, trademarks, trade names, trade dress, patents, domain names, product names, images, videos, or any other intellectual property rights reserved by Flashing Kings LLC, or any trademarks or service marks owned by suppliers to Flashing Kings LLC. All materials contained on the www.FlashingKings.com website are subject to the ownership rights of Flashing Kings LLC and its suppliers. Customers shall have no right to copy or use any of the intellectual property of Flashing Kings LLC without Flashing Kings LLC's permission.
FORCE MAJEURE
Flashing Kings LLC will not be liable for any delay in, or impairment of, performance resulting in whole or in part from any force majeure event. This includes but is not limited to: acts of God, labor disruptions, acts of war, acts of terrorism (actual or threatened), government decrees or controls, insurrections, epidemics, quarantines, shortages, communication or power failures, fire, accident, explosion, inability to procure or ship product or obtain permits and licenses, inability to procure supplies or raw materials, severe weather conditions, catastrophic events, or any other circumstance or cause beyond the reasonable control of Flashing Kings LLC in the conduct of its business.
ASSIGNMENT
Customer shall not assign any order, or any interest therein, without prior consent of Flashing Kings LLC. Any actual attempted assignment without Flashing Kings LLC's prior written consent shall entitle Flashing Kings LLC to cancel such order upon notice to customer.
NO THIRD PARTY BENEFIT
The provisions stated herein are for the sole benefit of the parties hereto, and confer no rights, benefits or claims upon any person or entity not a party hereto.
WAIVER, CHOICE OF LAW AND VENUE
The failure of either party to assert a right hereunder or to insist upon compliance with any term or condition will not constitute a waiver of that right or excuse any subsequent non performance of any such term or condition by the other party. All transactions shall be governed by the laws of the State of Colorado, excluding its conflict of law rules, and venue shall either be in the state courts in Fort Collins, CO or the appropriate federal courts for the district.
SEVERABILITY
If any portion of these terms and conditions is found to be invalid or unenforceable by a court of competent jurisdiction, the invalid or unenforceable term shall be severed from these terms and conditions, and the remaining terms and conditions shall be valid and fully enforceable as written.
MODIFICAION OF TERMS
Flashing Kings LLC's acceptance of any order is subject to customer’s assent to all of the terms and conditions set forth herein. Customer’s assent to these terms and conditions shall be presumed from customer’s receipt of Flashing Kings LLC's acknowledgment, or from customer’s acceptance of all or any part of the products ordered. No additions or modifications of Flashing Kings LLC's terms and conditions by customer shall be binding upon Flashing Kings LLC, unless agreed to in writing by an authorized representative of Flashing Kings LLC. If a purchase order or other correspondence submitted by customer contains terms or conditions contrary or in addition to the terms and conditions contained herein or in Flashing Kings LLC's acknowledgment, Flashing Kings LLC's fulfillment of any such purchase order shall not be construed as assent to any of the terms and conditions proposed by customer, and will not constitute a waiver by Flashing Kings LLC of any of the terms and conditions contained herein or in Flashing Kings LLC's acknowledgment.
COMPLETE AGREEMENT
The terms and conditions in: (i) Flashing Kings LLC forms, (ii) acknowledgments, (iii) quotations, (iv) invoices, (v) websites, (vi) catalogs are incorporated herein by reference, and constitute the entire and exclusive agreement between customer and Flashing KingsLLC.
